Exclusions and limitations of liability

Responsibility

The guide is solely and exclusively responsible for the preparation and proper conduct of the tours. GSE's role is limited to facilitating the booking of a guide through the website. GSE assumes no responsibility for the proper execution of the Guide Agreement or for any acts, omissions, errors, representations, warranties, breaches, or negligence of any guide, nor for any bodily injury, death, property damage, or other damages or expenses resulting from interactions between the user and the guide, as well as from the Guide Agreement. GSE is not responsible for delays, cancellations, overbooking, strikes, force majeure, or any other causes beyond its direct control.

Information and Content of the Website

The information on the website has been gathered in good faith by GSE. However, GSE cannot be held responsible for any incomplete or erroneous information. Additionally, GSE is not liable for any direct or indirect damages of any kind related to the use or access of the website, or the information, evaluations, or recommendations it contains.

Interruption and Access to the Website

GSE cannot be held responsible for direct or indirect damages resulting from the interruption of use or inability to access the website.

Limitation of Liability

In the unlikely event that GSE is held liable for any loss or damage arising from the use of the website or the service provided by GSE, or in connection with the Guide Agreement, its liability shall not exceed the maximum amount of two hundred euros (€200.00).

Protection of data

Collection and Use of Data Personal

To use the services provided on the website, the user may be asked to provide certain personal data, such as:

  • First and last name
  • Address
  • Email address
  • Phone number
  • Date of birth
  • Language
  • Copy of the ID card
  • Other data necessary for providing the service, such as specific preferences and requirements related to the travel

GSE processes these personal data for:
1. Allowing the user to access and use the features of the website.
2. Conducting market research, advertising, or direct marketing.
3. Communicating with the user and keeping them informed of any operations initiated by GSE that may be of interest.

Confidentiality and data sharing

Unless the communication of personal data to a third-party company is necessary to achieve the aforementioned objectives, GSE will not disclose, sell, rent, or exchange personal data to any company or entity other than an affiliate of GSE, without the explicit prior consent of the user.

Rights of the User

In accordance with applicable legal provisions, the user may:

  • To receive an overview or request the modification of their personal information processed by GSE, the user can send an email to georgiansummitexpedition@gmail.com.
  • To object to the use of their personal information for direct marketing activities, the user can submit a corresponding request to GSE.

Rights of Intellectual Property

The material presented on the website, including texts, images, logos, clips, trademarks, data, as well as their combination or compilation, is the physical and intellectual property of GSE or third parties with whom GSE has entered into license agreements or other agreements. This material may be protected by copyright, trademark rights, or other intellectual property laws. It is prohibited to copy, transmit, distribute, broadcast, sell, publish, transmit, arrange, or modify the material on the website, in whole or in part, without the express written permission of GSE. If the user wishes to reproduce or communicate this material to the public, they must obtain express written permission from GSE.

User's Obligations

The user must provide truthful information when requesting a guide. Only users who are of legal age according to applicable regulations can facilitate the booking of a guide on the website. GSE may request proof of the user's date of birth in certain cases.

The user is responsible for ensuring that their travel documents, including passports and visas, are in order for the booked trip. For passport and visa requirements, they should consult the relevant embassy or consulate. Additionally, the user must obtain travel insurance covering repatriation, health, and cancellation.

The user must ensure they are in good health, sufficiently fit, and possess an appropriate level of skill for the booked trip. If not, the guide reserves the right to exclude the user from the tour for safety reasons.

The user must have the appropriate and necessary equipment, defined in coordination with the guide, to handle potential risks such as sudden weather changes, rock falls, precipitation, crevasses, avalanches, etc. If the user is not properly equipped, the guide may ask them to purchase or rent suitable equipment or cancel the tour.

The user must inform GSE of any cancellation of a guide agreement, whether the cancellation comes from the user or the guide.

Once the user accepts the contract provided by GSE, the terms and conditions come into effect.

Services

GSE facilitates the booking of a guide for users through its website. The objective is to assist users in finding and booking an independent guide for outdoor recreational activities by structuring the request through a series of questions.

The guides listed on the site offer circuits they have designed themselves, but they can also provide personalized tours according to the users' preferences.

Booking Process

1. Tour request :
The user sends a tour request to a guide listed on the website, after accepting these terms and conditions. During the process, the user answers certain questions necessary for the guide to process the request.

2. Guide response:
The guide can respond by:

  • Making a formal offer based on the request.
  • Making a formal offer with modifications, based on the price and details of the tour listed on their page.
  • Refusing the request.

3. Conclusion of the Agreement :
- The offer is sent to the user along with the guide's terms and conditions, if applicable.
- The agreement is formed when the user accepts the offer and the guide's terms and conditions.
- Any modification to the contract requires written acceptance by the user.
- Without payment from the user within 30 days, the agreement will be automatically canceled without notification.

Cancellations and Modifications

- Weather conditions :
If inclement weather or inadequate conditions require the guide to cancel the trip, the guide can:

  • Propose an alternative activity in a different location.
  • Propose to reschedule the activity to a later date.
  • Cancel activity.
  • If the user refuses the replacement option, the cancellation policy applies.
  • Cancellation due to bad weather is decided by the guide, although a partial refund may be offered at the guide's discretion.

Non-Refundable Fees

By booking a trip, the user acknowledges and accepts that the following fees are non-refundable:

  • Administrative Fees: 3% of the total tour price.
  • Service Fees: 27% of the total tour price.
  • Non-refundable fees paid by the guide to organize the trip (accommodation, administration, salaries, porters, food, etc.), defined at the time of the client's cancellation request.
  • Credit Card Fees: approximately 1.6% of the amount paid by credit card.
  • Any other fees clearly mentioned as non-refundable before booking.

Cancellation Policy

Cancellation before 30 days :

  • Full refund except for 30% deposit, administrative fees, service fees, and credit card fees.

Cancellation before 20 days :

  • Full refund except for 50% deposit, administrative fees, service fees, and credit card fees.
  • Cancellation within 20 days :
    No refunds possible.

Publication of notices

GSE allows users to post reviews (text/photo) about their trip on the website. Reviews must be written in a fair and objective manner, providing useful information to other users. GSE reserves the right to delete any review without notice at its sole discretion.

By accepting the contract provided by GSE, the terms and conditions come into effect.
